  昨日下午，记者联系上了思明区法院经办此案的法官。
    经办法官表示，《中华人民共和国食品卫生法》第八条规定：食品生产经营过程中，餐具、饮
具和盛放直接入口食品的容器，使用前必须洗净、消毒，炊具用后必须洗净，保持清洁。依据法规
，向消费者提供符合卫生标准的餐具和纸巾等是餐饮行业的法定义务。而且，《餐饮修理业价格行
为规则》第八条也规定：餐饮服务项目除国家另有规定外，经营者不得随意收取任何名目的价外服务
费或其他形式的价外加价。

    “‘消毒餐具’应该是餐馆的配套服务，收1元作为‘消毒餐具’的费用，也就相当于变相收费！
”经办法官表示，这种做法也违反了《消费者权益保护法》。

    “你告诉我这个餐具是收费的，就能收这1元钱？”经办法官说，不管店家有没有告知，“消毒餐具”
都不应由消费者买单。

    《消费者权益保护法》第二十四条规定：经营者不得以格式合同、通知、声明、店堂告示等方式作出
对消费者不公平、不合理的规定，或者减轻、免除其损害消费者合法权益应当承担的民事责任。格式合同、
通知、声明、店堂告示等含有前款所列内容的，其内容无效。

    经办法官认为，消费者在餐饮店就餐，就和餐饮店形成了餐饮服务合同，餐饮店理应保障消费者的饮
食安全和卫生。消费者在餐饮店就餐时，餐饮店理应免费提供符合卫生标准的餐具和纸巾，不得另行收费。
